Chief Justice Remarks on Courtroom Exchange

Chief Justice Sardar Muhammad Sarfraz Dogar of the Islamabad High Court (IHC) has clarified his recent remarks made during a conversation with rights activist and attorney Imaan Zainab Mazari-Hazir. On Friday, he explained that his comments had been taken out of context.

During a hearing on lifting Mahrang Baloch’s Exit Control List restriction, Justice Dogar cautioned Mazari about potential contempt of court charges after she reportedly labeled him a ‘dictator’.

Clarification of Misunderstandings

The controversy reignited during separate court proceedings. Justice Dogar expressed that he regarded Mazari as ‘just like a daughter’ and aimed to clear up any misunderstandings from their previous interaction.

He stated, ‘As the chief justice and an elder, I was attempting to help her understand.’ He regretted that his words were misconstrued, leading to ‘a storm brewing’. Justice Dogar emphasized that while Mazari is entitled to disagree with his judgments, criticisms should remain impersonal.

Explaining Concerning Statements

In the exchange, Justice Dogar addressed Mazari’s husband, Hadi Ali Chatha, saying, ‘Hadi sahib, make her understand; if I get hold of her someday…’

He clarified that there was no threat of physical action, stating, ‘I did not say that I will get hold of her, although this has been circulating since yesterday.’ Justice Dogar explained he encouraged Chatha to accompany Mazari to prevent any contempt proceedings that could negatively affect her career.

Professional Conduct Emphasized

Justice Dogar reiterated, ‘I explained things as I would to a child, but she was not understanding.’ He questioned, ‘She was continuously emphasizing fundamental rights, but does this court not have its own rights?’

Mazari’s Response to Clarifications

Following the hearing, Mazari, known for her outspoken views, responded on X. She emphasized, ‘It is vital for CJ IHC to know I am in court as a lawyer representing my client, adhering to professional conduct, and a court should reciprocate.’
